नई दिल्ली/ पटना। केंद्र सरकार ने बिहार में जातिगत सर्वे को लेकर सुप्रीम कोर्ट में बीते सोमवार सुबह दाखिल किया हलफनामा कुछ घंटे बाद वापस ले लिया। पहले हलफनामे के पैरा 5 में लिखा था- सेंसस एक्ट 1948 के तहत केंद्र के अलावा किसी और सरकार को जनगणना या इससे मिलती-जुलती प्रकिया को अंजाम देने का अधिकार नहीं है।
बाद में केंद्र ने इस हिस्से को हटाते हुए नया हलफनामा दायर किया। इसमें कहा- पैरा 5 अनजाने में शामिल हो गया था। नया हलफनामा संवैधानिक और कानूनी स्थिति साफ करने के लिए दायर किया है। केंद्र सरकार भारत के संविधान के प्रावधानों के अनुसार SC/ST/SEBC और OBC के स्तर को उठाने के लिए सभी कदम उठा रही है।
नए हलफनामे से स्पष्ट हो गया कि राज्य जातीय सर्वे या उससे जुड़े आंकड़े जुटा सकते हैं। इससे पहले बिहार सरकार पटना हाईकोर्ट में कह चुकी है कि यह जनगणना नहीं, बल्कि सर्वे है। इसके बाद ही पटना हाईकोर्ट ने बिहार सरकार को सर्वे कराने को हरी झंडी दे थी।
ज्ञात हो कि, इससे पहले 21 अगस्त को सुनवाई हुई थी। केंद्र सरकार की ओर से सॉलिसिटर जनरल तुषार मेहता ने दलीलें दी थीं। उन्होंने कहा था कि वे इस केस में किसी पक्ष के साथ नहीं हैं। केवल इसके रिजल्ट को लेकर अपना पक्ष रखना चाहते हैं। जस्टिस संजीव खन्ना और जस्टिस भट्टी की कोर्ट से मेहता ने 7 दिन का समय मांगा था। इसके बाद 28 अगस्त की तारीख दे दी गई थी।
कोर्ट में बिहार सरकार ने दलील देते हुए कहा कि राज्य में गणना का काम 6 अगस्त को पूरा हो चुका है। सारे डेटा भी ऑनलाइन अपलोड कर दिए गए हैं। इसके बाद याचिकाकर्ता ने डेटा रिलीज करवाने की मांग की थी।

केंद्र सरकार ने नए एफिडेविट में भी अलग ढंग से ही सही, लेकिन पहले वाली बात ही दोहराई है। सरकार ने कहा, ‘जनगणना एक सांविधिक प्रक्रिया है, जिसका संचालन जनगणना अधिनियम, 1948 के तहत किया जाता है। यह केंद्रीय सूची में आता है और संविधान की 7वीं अनुसूची में इसका जिक्र किया गया है। यह अधिनियम सिर्फ केंद्र सरकार को ही यह शक्ति देता है कि वह जनगणना अधिनियम, 1948 के तहत जनगणना करा सके। इसका प्रावधान ऐक्ट के सेक्शन 3 में किया गया है।’ पटना हाई कोर्ट ने बिहार सरकार की ओर से जातीय जनगणना को मंजूरी दी थी, जिसके बाद उसके खिलाफ सुप्रीम कोर्ट में अर्जियां डाली गई हैं। इन्हीं पर सुनवाई के दौरान केंद्र ने हलफनामा दिया है।
